Terms and Conditions DKMF Fight Concepts

Every participant is required to read the Terms and Conditions of DKMF Fight Concepts. Where an agreement exists between DKMF Fight Concepts and the participant, these Terms and Conditions form an integral and inseparable part of that agreement.

Membership & Fees

1. Upon registration, the first month's fee and the registration fee must be paid before the first training session via the payment link included in the welcome message sent after registration. During the term of the membership, membership fees must be paid monthly in advance.

2. Each month, approximately 14 days before the upcoming training month, an email containing the membership invoice will be sent to the email address provided upon registration. The corresponding payment link will be sent separately via WhatsApp. Payment must be received before the due date stated in the message.

3. You are responsible for ensuring that the email address and telephone number you provide are valid and functioning correctly.

4. Any changes to your address, telephone number, email address, subscription, membership or other relevant details must be reported to DKMF Fight Concepts immediately.

5. Please pay on time. A fee of € 7.50 will be charged for each reminder following late payment. After the third reminder, the claim will be referred for collection. This may result in substantial additional costs, including a minimum of € 45.00 for the first collection letter. Each reminder grants an additional three days for payment.

6. Participation in training is not permitted while any payment is overdue.

7. Current rates can be found on our website.

8. Membership continues until it is cancelled. Cancellation can only be submitted online using the designated cancellation form and must be completed before the membership invoice for the next period has been issued. Membership invoices are sent approximately 14 days before the start of the new period.

Cancellations submitted through other media or channels will not be processed.

If an invoice is still outstanding at the time of cancellation, it must be paid. If the membership invoice for the new period has already been issued, that invoice must also be paid.

Membership fees that have already been paid will not be refunded, either in full or in part.

9. An overdue payment does not constitute cancellation. As long as the membership has not been cancelled in accordance with Article 8, the obligation to pay membership fees continues. Stopping training or stopping payments expressly does not constitute cancellation. If payment is not made, the claim may be referred for collection.

10. Membership fees continue during holiday periods, personal holidays, other personal reasons for prolonged absence and public holidays. Where circumstances permit, training will continue during holiday periods according to an adjusted holiday schedule where applicable. If you cancel your membership before a holiday period and subsequently register again, the registration fee will be charged again. Any discounts or promotional rates previously granted will lapse upon re-registration.

11. Membership fees also continue in the event of prolonged illness or injury. Memberships cannot be paused or frozen.

12. Long-term contracts

(a) The annual subscription for regular training is collected monthly. This contract cannot be cancelled during the agreed term. After 12 months, the contract is automatically renewed for a further period of one year. If the member wishes, the contract may be converted after 12 months into a contract that can be cancelled monthly. The member is responsible for taking the necessary action in good time.

(b) Annual contracts for instructor courses and Jeugdfonds Sport & Cultuur. These agreements have a term of one year and may, if desired, be converted after expiry into a contract that can be cancelled monthly. Early cancellation of an annual contract is not possible. No refunds will be provided.

13. Discounts and changes to membership fees

(a) Membership fees will in principle not be increased during the agreed term unless imposed measures or circumstances make an adjustment necessary.

(b) Where a member has registered at a promotional rate or with another discount, the membership fee will not be increased to the regular rate for the duration of that discount unless the relevant promotion expressly states that it applies for a limited period. Previously granted discounts lapse upon cancellation and subsequent re-registration. The rate applicable at the time of re-registration will then apply.

(c) Discounts cannot be combined.

General

14. The minimum age for participation in training is generally approximately 16 years. The participant's physical and general development may also be taken into account.

15. Participants must be present at least 10 minutes before the start of training.

16. The instructor reserves the right to remove participants from the training location and/or terminate membership unilaterally in the event of disruptive, undesirable or inappropriate behaviour before, during or after training. Krav Maga Hybrid, Eskrima and/or Hybrid Combat System may only be used outside the training location where necessary to defend yourself or a third party against a real and immediate threat. In all situations, any action taken must be proportionate and necessary. The use of Krav Maga Hybrid, Eskrima and/or Hybrid Combat System for unlawful purposes may result in immediate termination of membership and, where appropriate, notification or reporting to the competent authorities.

17. Every participant in Krav Maga Hybrid, Eskrima and/or Hybrid Combat System must have valid personal liability insurance.

18. The dojo or training hall may only be left during a training session after notifying and obtaining permission from the instructor.

19. Every training partner must be treated with respect and normal standards of conduct must be observed. If a training partner asks you to stop or to perform an exercise with less intensity, you must comply immediately.

20. You train with the person who invites you or with the training partner assigned to you by the instructor.

21. Uncontrolled aggression will not be tolerated. Uncontrolled training that may cause injury or negatively affect the training experience of others is not accepted.

22. If you injure another participant during training and medical assistance is required, you may be required to accompany that person to a doctor or emergency department. Any damage or costs caused by your actions may, where applicable, be recovered from you.

23. When training with a beginner or someone with a lower level of training, you must adapt your own intensity and level accordingly. Your primary responsibility is to allow your training partner to train safely and to help them develop further.

24. During training, no persons other than participants and persons taking part in a trial or introductory training session with the permission of DKMF Fight Concepts are permitted on the training floor.

25. Mobile phones and similar devices must be switched off or set to silent during training. If you need to remain reachable because of a possible emergency, you must inform the instructor beforehand.

26. Eating during training is not permitted. If eating may be necessary for medical reasons, this must be reported to the instructor beforehand. Water bottles are permitted.

27. Smoking in the training area is prohibited.

28. Participants who are under the influence of alcohol, drugs or other substances that may affect their functioning will not be admitted to training or will be removed from training immediately.

29. Taking photographs, video recordings, audio recordings or any other type of recording during training without prior permission is prohibited.

HEALTH AND MEDICAL CIRCUMSTANCES

30. Injuries, complaints, physical limitations and other physical or psychological circumstances that may affect safe participation in training must be reported in writing before registration, preferably via the registration form. You must also report in advance if you use medication that may affect your concentration, coordination or physical capacity.

DKMF Fight Concepts is not medically qualified and cannot assess medical complaints, limitations or risks.

If you have known, suspected or previously diagnosed physical or psychological complaints, you are responsible for consulting a doctor or other appropriately qualified medical professional before participating and for following their advice.

By registering and participating in training, you declare that you have taken the necessary steps to ensure that you can participate responsibly.

Participation in training is at your own risk and responsibility, subject to the provisions set out below under Liability.

HYGIENE, CLOTHING, PROTECTION AND EQUIPMENT

31. Every participant must maintain good personal hygiene, including short and clean fingernails and clean sports clothing.

32. Wounds must be properly covered before training. Any blood on the floor or training mat must be removed immediately. Participants are required to carry a basic first-aid set during training consisting of at least good-quality plasters and tape.

33. Piercings, jewellery, glasses and similar items are not permitted during training for safety reasons. Some piercings may be covered with tape, subject to the instructor's assessment. Contact lenses are worn at your own risk.

34. Long hair must be tied back using an elastic band or similar item without sharp or hard parts.

35. Required training equipment can be purchased through the instructor. To avoid purchasing unsuitable or incorrect equipment, participants are advised to consult the instructor before purchasing equipment independently.

36. Prescribed training clothing consists of long black training trousers and a T-shirt. Sleeves and trouser legs must not be rolled up during training. Every participant must also have a mouthguard, MMA gloves and a groin protector. Female participants are advised to wear a suitable sports bra with flexible plastic protection.

37. The dojo or training hall may only be entered wearing suitable indoor training shoes. Training in socks only is not permitted because of the risk of injury.

38. Participants in Eskrima training must have their own set of training equipment within one month of registration and bring it to every relevant training session. This set consists of a kubotan, a rattan stick approximately 70 cm long and a metal training knife.

39. With the exception of the kubotan, training weapons may only be transported for training purposes between home and the training location and vice versa. They must be transported out of sight in a closed sports bag.

40. Punch pads, kick pads and similar general training equipment are provided by DKMF Fight Concepts. Training pistols are provided exclusively by the instructor.

LIABILITY

41. Participation in Krav Maga Hybrid, Eskrima and Hybrid Combat System training at DKMF Fight Concepts is at the participant's own risk. DKMF Fight Concepts, the instructor and any assistants or substitutes appointed by the instructor are not liable for loss, theft of or damage to participants' personal property.

DKMF Fight Concepts, the instructor and any assistants or substitutes appointed by the instructor likewise accept no liability for personal or bodily injury and any resulting direct or indirect damage, insofar as such liability may legally be excluded or limited.

This also applies to damage connected with existing complaints, injuries or limitations that were known beforehand or aggravated during training, regardless of whether they were reported in advance.

DKMF Fight Concepts is not liable for damage resulting from failure to report, or incomplete reporting of, medical complaints, limitations or the use of medication as referred to in Article 30, insofar as such liability may legally be excluded or limited.

42. By submitting the registration form digitally and ticking the box "I agree to the Terms and Conditions of DKMF Fight Concepts", the participant declares that he or she:

• has read these Terms and Conditions and agrees to them;

• is aware of the risks associated with practising Krav Maga Hybrid, Eskrima and Hybrid Combat System;

• has read Article 30 and understands the obligations and responsibilities stated therein;

• where applicable, has independently obtained appropriate medical advice before participating;

• accepts responsibility for the consequences of participation insofar as these may legally be for the participant's own account and risk;

• will, insofar as legally permitted, indemnify DKMF Fight Concepts and/or its management and instructors against third-party claims resulting from the participant's acts or omissions.

43. In cases not covered by these Terms and Conditions, the management of DKMF Fight Concepts will decide, subject to applicable laws and regulations.

DKMF Fight Concepts reserves the right to amend and/or modify these Terms and Conditions.

Our website and/or service does not intend to collect data about website visitors under the age of 16 unless they have permission from a parent or guardian. However, we cannot verify whether a visitor is over the age of 16. We therefore advise parents to be involved in their children's online activities in order to prevent data about children from being collected without parental consent. If you believe that we have collected personal data about a minor without such consent, please contact us via info@kravmaga-hybrid.com and we will delete this information.

DKMF Fight Concepts processes your personal data for the following purposes:

DKMF Fight Concepts does not make decisions based on automated processing that could have significant consequences for individuals. This concerns decisions made by computer programs or systems without human involvement. DKMF Fight Concepts uses the following computer programs or systems:

For as long as the membership/relationship with DKMF Fight Concepts continues. Data is deleted immediately after cancellation.

DKMF Fight Concepts only provides personal data to third parties where this is necessary for the performance of our agreement with you or to comply with a legal obligation.

• Cookies or similar technologies we use
DKMF Fight Concepts does not use cookies or similar technologies.

• Accessing, correcting or deleting data
You have the right to access, correct or delete your personal data. You also have the right to withdraw any consent you have given for data processing or to object to the processing of your personal data by DKMF Fight Concepts, and you have the right to data portability. This means that you may submit a request to us to send the personal data we hold about you in a computer file to you or to another organisation named by you.

You can send a request for access, correction, deletion or transfer of your personal data, or a request to withdraw your consent or object to the processing of your personal data, to info@kravmaga-hybrid.com.

To ensure that the request for access was made by you, we ask you to include a copy of your identity document with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and Dutch citizen service number (BSN). This is to protect your privacy. We will respond as soon as possible, but within four weeks.

DKMF Fight Concepts would also like to point out that you have the option of submitting a complaint to the Dutch supervisory authority, the Autoriteit Persoonsgegevens. DKMF Fight Concepts does not retain your personal data for longer than is strictly necessary to achieve the purposes for which your data is collected. We use the following retention periods for the following categories of personal data:
